CSC charge amended

CRYSTAL FALLS—The criminal sexual conduct charge against a Crystal Falls man has been amended, and the case has been remanded back to district court after a motions hearing in Iron County Trial Court on July 31.
    Connor Timothy Dalpra, 21, is now facing a first-degree criminal sexual conduct charge instead the original charge of third-degree CSC. Marquette County Assistant Prosecutor Autumn Gruss, who is handling the case by assignment by the state court administrator’s office, put forth the amendment to the information that changed the charge because of the added element of personal injury.
    “I’m alleging that would be the mental anguish suffered by the victim in this case,” Gruss argued. “I believe there was plenty of evidence at the preliminary examination, including the fact that she was crying immediately afterwards, she was upset, she started crying when she was talking about it, as well as seeking professional help.
    “I believe all of those go to the mental injuries suffered.”
    The criminal complaint in the case accuses Dalpra of engaging in sexual conduct with an incapacitated victim while “knowing or having reason to know” that the victim was physically helpless on July 1, 2017.
    Defense attorney Roy Polich argued against allowing the charged to be amended.
